Terms and conditions of use and sale

2Purpose

These terms and conditions govern the use of the Tailor Tune website and the sale of personalised song creation services, as digital content and, where applicable, personalised physical products.

Placing an order implies full and unreserved acceptance of these terms and conditions.

3Use of the website

The Tailor Tune website is intended for personal, non-commercial use.

Any abusive, fraudulent or improper use of the website is strictly prohibited, including:

• automated extraction of data or content;
• the use of robots, scripts or similar means;
• any attempt to gain unauthorised access to the website systems;
• any action intended to disrupt the proper operation of the service.

Tailor Tune reserves the right to suspend or block access to the website, without notice, in the event of a breach of these terms and conditions.

4Orders

Orders are placed online through the Tailor Tune website.

An order is considered final once payment has been confirmed and the customer has provided all the information needed for the creation.

Tailor Tune reserves the right to refuse or cancel any order that is incomplete, non-compliant, or that infringes the rights of third parties, public order or the values of the service.

5Creation and delivery times

A working day means any day from Monday to Saturday, excluding Sunday.

Standard service: the lyrics are sent within an indicative period of one (1) working day after the order. The final song is delivered within an indicative period of two (2) working days after the customer approves the lyrics. Any order placed on a Sunday is handled on the next working day.

Lead times are indicative and may vary depending on the complexity of the request or the volume of orders.

"24h Express" option: this paid option gives the order priority processing. The lead time corresponds to a processing time of one working day, excluding Sunday. It runs from the confirmation of the order and the receipt of all the information needed for the creation.

This option does not constitute an obligation of permanent availability. In the event of force majeure or a technical difficulty beyond the control of Tailor Tune, a slight delay may exceptionally occur.

6Prices and payment

Prices are shown in euros, including all taxes.

Full payment is required when the order is placed. No delivery will be made without confirmation of payment.

Tailor Tune reserves the right to change its prices at any time, with no retroactive effect on orders already confirmed.

7No right of withdrawal and revisions

Personalised digital content: in accordance with Article L221-28 of the French Consumer Code, personalised digital content can be neither exchanged nor refunded.

Depending on the offer selected, minor revisions may be offered. These revisions only cover reasonable adjustments and constitute neither a new order nor a complete re-creation of the work. Tailor Tune reserves the right to refuse any request that is manifestly excessive, abusive or incompatible with the personalised nature of the service.

Personalised physical products: when the order includes a personalised physical product (printed medium, merchandise, etc.), it is made to order by a third-party production partner, based on the elements provided by the customer.

In accordance with Article L221-28 of the French Consumer Code, personalised physical products are not covered by the right of withdrawal and can be neither exchanged nor refunded once production has started. No cancellation, change or refund can be accepted once the order has been sent to the production partner.

8Delivery

Digital content is delivered electronically to the email address given when ordering.

Physical products, where applicable, are shipped by the production partner according to its own logistics arrangements.

Tailor Tune cannot be held liable for any delay or non-receipt resulting from:

• an incorrect address provided by the customer;
• a technical malfunction;
• a delay attributable to the carrier or the production partner.

9Intellectual property

Unless otherwise stated, the creations delivered are intended for strictly personal use.

Any commercial use, public broadcast, reproduction, modification or resale is prohibited without the prior written consent of Tailor Tune.

10Liability

The liability of Tailor Tune is strictly limited to the amount of the order concerned.

No liability may be incurred for indirect, non-material or subjective damage, in particular emotional, artistic or social damage, related to the use of the creations delivered.

11Personal data and confidentiality

In the course of an order, Tailor Tune collects and processes certain personal data needed to deliver the service (in particular: first name, email address, order information). This data is used exclusively for:

• managing and fulfilling orders;
• communicating with the customer;
• improving the service.

Personal data is never sold, transferred or used for commercial purposes. It may only be shared with the technical service providers strictly necessary to deliver the service (payment, hosting, email delivery), or where required by law.

In accordance with the GDPR, the customer has the right to access, rectify, erase and object to the processing of their personal data, which they can exercise by writing to contact@tailortune.com.

Confidentiality of content: the information provided by the customer for the creation of a personalised song (texts, first names, anecdotes, personal messages, life events) is treated in strict confidence. Tailor Tune undertakes not to disclose this information to third parties and to use it solely to fulfil the order, unless the customer expressly agrees otherwise.

Use of creations for presentation purposes: unless the customer explicitly objects in writing, Tailor Tune reserves the right to use certain creations or excerpts (audio, lyrics, visuals) to present or promote its services. No information that could identify the customer or the people concerned will be published without prior consent.

12Changes to the terms

Tailor Tune reserves the right to change these terms and conditions at any time. The applicable terms are those in force on the date of the order.

13Governing law and disputes

These terms and conditions are governed by French law.

In the event of a dispute, the customer is invited to contact Tailor Tune first at contact@tailortune.com to seek an amicable solution. Failing that, the dispute will be brought before the competent courts under ordinary law.
